The General Terms and Conditions of Sale
The General Terms and Conditions of Sale are concluded between the person making a purchase on the online sales site www.ekoi.fr and the Company JCR EKOI. The person making the purchase must be of age.

The customer acknowledges having read these General Terms and Conditions of Sale and accepts them. The validation of the order by the customer implies the acceptance without any reserve of these General Conditions of Sale.
The characteristics of the products you order are indicated on the pages of the www.ekoi.fr website. Ekoï is committed to presenting the products as accurately as possible.
All products offered by Ekoï are subject to the following conditions
All products offered are in accordance with French legislation.
Only the information found on the product sheet has the value of proof between Ekoï and the buyer. This information can be modified or deleted by the seller Ekoï.
The seller Ekoï undertakes to ship all products ordered and paid for by the buyer within the limits of available stocks.
If a product is out of stock after the buyer's order has been finalised, Ekoï will inform the customer by email or telephone and undertakes to offer the customer a choice of:
- A refund equivalent to the amount of the order - A credit note equivalent to the value of the broken product, credited to the customer's account
- An exchange
In the case of a refund request, Ekoï undertakes to make the customer's refund within a maximum of 3 working days from the day of the customer's request. The refund will be made directly to the bank account used for the payment of the order.
The refund will be made to the customer's bank account.
For deliveries of Ekoï products made within the European Union, the prices indicated are inclusive of all taxes and do not include any preparation and delivery costs.
For deliveries outside the metropolitan territory of the European Union, the prices are expressed excluding any taxes. The Customer undertakes to pay, where applicable, any taxes that may be requested by the Country of delivery, and in particular value added tax and any customs duties. These duties may be requested by the carrier. Ekoï cannot be held responsible in the event that the Customer does not pay these taxes and duties. In the event of the Customer's refusal, Ekoï reserves the right to invoice the Customer for the shipping and return costs of the package and a fixed cost for preparing the order (variable depending on the order: 5€ to 15€). In case of refusal of glasses, helmet or shoes personalised with the Customer's name, the refund cannot be made.
The valid price is the one displayed on the product sheet at the date of purchase.
Delivery costs may be charged with your order depending on its total amount and the country of delivery of the order.
The amount (product price and delivery costs) indicated in the order confirmation by Ekoï is the total price to be paid by the Customer.
The JCR company reserves the right to modify its prices at any time.
The total price of the paid order includes:
- The total price of the products purchased with any discounts deducted.
- The costs of preparing the order.
- The shipping costs of the order.
In the context of commercial operations, flash sales or promotions, the prices displayed may change downwards temporarily over a period of time indicated on the site.
These possible price reductions cannot be the subject of a request for reimbursement from the buyer if he/she had paid for the product(s) at a higher price outside the promotional period. Conversely, Ekoï is bound to respect the prices displayed on the day of the order validation, including in the event of an increase.
Price display error
The prices displayed are subject to visible errors. In the event of an obvious error in the display of prices, Ekoï undertakes to contact the customer to warn them and to offer them to pay the price difference or to cancel their order if they so wish.
In order to validate his order, the buyer must follow several steps:
- He/she selects the products he/she wishes to buy on the website www.ekoi.fr from the offer available on the website.
- He must identify himself (account already created) or create a customer account on the site by filling in the necessary information (surname, first name, physical address, telephone number, email).
- The buyer validates the information related to his order (products, price, address).
- The buyer chooses the type of delivery and payment method he/she wishes
- The buyer accepts the present GTC (check box)
- The buyer validates his order via a secure payment module (SSL)
This last step constitutes the irrevocable acceptance of the sales contract.
We reserve the right to refuse any order from a customer with whom there is a dispute.
Unless there are exceptional circumstances, all products in an order will be delivered at once. The products will be delivered to the delivery address that the customer will have indicated at the time of validation of his order.
For orders including one or more products that are unavailable at the time of shipment, Ekoï reserves the right to ship the order without the unavailable products. In this case, the buyer will be reimbursed or credited with a credit note equivalent to the amounts of the unavailable products.
On receipt of the products, the customer must check the condition of the products they have purchased.
Mode of delivery
Many types of delivery are possible depending on the customer's choice.
For orders with delivery in mainland France, 2 possible solutions:
- Delivery to a relay point by Mondial Relay.
- Home delivery or point relay delivery by UPS.
For orders with delivery in Belgium, 3 possible solutions:
- Delivery at home or at a relay point by UPS.
- Home delivery by DHL.
- Delivery to relay points by Mondial Relay.
For orders with delivery outside mainland France or Belgium, delivery is by UPS, DHL or Mondial Relay.
Delivery time varies depending on the type and country of delivery.
Delivery time means from the moment the order is shipped from Ekoï's premises.
For all orders placed between Monday and Friday before 2pm (excluding public holidays), the order will be shipped the same day.
For orders placed between Monday and Thursday after 2pm (excluding public holidays), orders will be dispatched the next day after 2pm.
For orders placed on Friday after 2pm, Saturday and Sunday, orders will be dispatched the following Monday afternoon (excluding public holidays).
For orders placed on a public holiday, orders will be dispatched on the afternoon of the following working day. Delivery times are once the order has been dispatched.
The delivery times announced on the website are valid from the moment the customer receives the order confirmation email.
For a delivery in a relay point, the customer has 15 days to collect his parcel after notification by email of its availability. After this period, the package will be returned to Ekoï who will contact the customer again. If there is no response, the order will be cancelled and the customer reimbursed within the framework of the right of withdrawal.

Postage costs are inclusive of all taxes. The amount of the shipping costs is visible on the "BASKET SUMMARY" page in the purchase tunnel and corresponds to the line "Shipping costs including VAT".
Products can only be returned under the right of withdrawal. The customer has 14 working days from the date of receipt of his order to make his return request by contacting Customer Service. The customer then has 30 days to return the products.
For all return requests, it is mandatory to contact Ekoï Customer Service before returning any products. If this is not done, the return request cannot be processed upon receipt.

To make a return, it is necessary to validate the terms of the return with Customer Service.
An item returned within 30 days of the date of receipt of the order may be refunded or benefit from a credit note depending on the customer's choice.
An item returned beyond 30 days from the date of receipt of the order will only be eligible for a credit note.
Return costs are completely free for the customer (for Belgium, France Metropolitan, Germany, Spain, Italy, Luxembourg, Netherlands, Austria, Poland, Denmark, Czech Republic, Sweden, Slovenia,).
The procedure is as follows:
Make the request:
Just go to your customer account and click on the My Product Returns section.
- Select the order concerned.
- Tick the quantity of the product(s) you wish to return.
- Select one of the options: Have, Exchange or Refund.
- Once the return request has been registered, your return label will appear on the screen and is ready to be printed.
Prepare the package:
- Add the photocopy of your invoice to the package or write your contact details and order number on plain paper.
- Return the product(s) with the labels attached and in their original packaging.
- Print the return label and stick it on the package. If you are reusing the original package, remember to remove the first label.

Returned products can only be tried-on products (not worn in training, nor washed). Gifts offered with the products must also be returned (present on invoices, and order history).
Within the framework of the right of withdrawal, the customer has 14 working days from the date of receipt of his order, to make his request for return by contacting Customer Service. They then have 30 days to return the products. The returned products must be in perfect condition, unworn and in their original packaging.In accordance with the provisions of Article L 121-20-2 of the Consumer Code, the right of withdrawal cannot be exercised for personalised and perishable products.
PLEASE NOTE, no right of withdrawal is possible on personalised and perishable products (e.g. helmet with personalised sticker, personalised glasses...).

In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, JCR adheres to the FEVAD (Fédération du e-commerce et de la vente à distance) E-commerce Mediation Service whose contact details are as follows: 60 Rue La Boétie - 75008 Paris - http://www.mediateurfevad.fr. To finalize his order, the customer has several means of payment:

The products remain the property of Ekoï until the payment of the order. Ekoï reserves the right to block or cancel an order in case of total or partial non-payment of the order.

VOIRS AND REFUNDS
For any defective products or for a product delivery error on our part, a credit note or a refund of the total amount received (product + postage + return postage, based on La Poste rates) will be offered to the customer.
Credit notes and vouchers are not applicable to paper orders.
The helmets are guaranteed for 2 years.
The textiles, glasses and accessories are guaranteed for 2 years.
Ekoï guarantees its products against any manufacturing defect. Any Ekoï product returned under warranty and recognized as defective by Ekoï, will be replaced within 8 working days by an identical or superior model.
Ekoï products are guaranteed to be free of defects.
Products returned for inspection must be sent postage paid to our warehouse (address below), accompanied by a dated proof of purchase and a letter explaining the reasons for the return.
The warranty does not cover normal wear and tear or damage caused by accident, neglect, abuse or damage resulting from exposure of the product to excessive temperature.
The data collected on the site is for internal use only and allows us to process orders. JCR does not consent to any disclosure of this information. You agree to give your consent to such use of nominative data. In application of the French Data Protection Act of 6 January 1978, the customer has the right to access, rectify and object to the data recorded concerning him. This right of rectification may be exercised at any time by mail sent to our address.
Commercial offers are exclusively reserved and applicable on the Ekoï website, excluding special mentions.
This contract is subject to French law, the language of the contract is French.Any dispute arising in connection with the application or interpretation of this contract shall be submitted to the French courts, which shall have sole jurisdiction.

INFORMATIONS CONCERNING THE EXERCISE OF THE RIGHT OF WITHDRAWAL
Right of withdrawal
You have the right to withdraw from this contract without giving any reason within fourteen days. The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the last item. To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement (e.g. letter sent by post, fax or e-mail). Alternatively, you can fill in and submit the sample withdrawal form. All the modalities of returns are detailed in paragraph 5.5 which we invite you to read in order to exercise the right of withdrawal.
