The General Terms and Conditions of Sale are concluded between the person making a purchase on the online sales site www.ekoi.fr and the Company JCR EKOI. The person making the purchase must be of age.
The buyer acknowledges having read these Terms and Conditions of Sale and accepts them. The validation of the order by the customer entails the acceptance without any reservation of these Terms and Conditions of Sale.

These general terms and conditions of sale (hereinafter the "GTC") govern the terms and conditions of sale of all products presented, by the company JCR SAS (hereinafter "Ekoï"), on its website www.ekoi.fr (hereinafter the "Site"), to any person of legal age, having the quality of consumer, within the meaning of the introductory article of the French Consumer Code, as well as the capacity (hereinafter the "Buyer").
Ekoï reserves the right to modify the GTC at any time. The modifications are opposable to the Buyers as of their posting online and cannot be applied to transactions concluded previously. A copy of the GTCs applicable at the date of the order is available upon request from the Buyer.
Please note that the GTCs are not binding on the Buyer
3.1 Product Features
The characteristics of the products you order are indicated on the pages of the www.ekoi.fr website. Ekoï is committed to presenting the products as accurately as possible.
All products offered are in accordance with French legislation.
Only the information found on the product sheet has the value of proof between Ekoï and the buyer. This information can be modified or deleted by the seller Ekoï.
3.2 Product Availability
Seller Ekoï undertakes to ship all products ordered and paid for by the buyer within the limits of available stocks.
If a product should be out of stock after the buyer's order has been finalized, Ekoï will inform the customer by email or telephone and undertakes to offer the customer a choice:
- A refund equivalent to the value of the out of stock product
- A credit note equivalent to the value of the broken product, credited to the customer's account
- An exchange
In the case of a refund request, Ekoï undertakes to make the customer's refund within a maximum of 3 working days from the day of the customer's request.
For deliveries of Ekoï products made within the metropolitan territory of the European Union, the prices indicated are inclusive of all taxes and do not include any preparation and delivery costs.
For deliveries outside the metropolitan territory of the European Union, the prices are expressed excluding any taxes. The Customer undertakes to pay, where applicable, all taxes that may be required of him by the Country of delivery, and in particular the value added tax and any customs duties. These duties may be requested by the carrier. Ekoï cannot be held responsible if the Customer does not pay these taxes and duties. In the event of the Customer's refusal, Ekoï reserves the right to charge the Customer the shipping and return costs of the package and a fixed cost for preparing the order (variable depending on the order: 5€ to 15€). In case of refusal of Glasses, Helmet or Shoes personalized with the name of the Customer, the refund cannot be made.
The valid price is the one displayed on the product sheet at the date of purchase.
Shipping fees may be charged with your order depending on its total amount and the country of delivery of the order.
The amount (product price and shipping costs) indicated in the order confirmation by Ekoï is the total price to be paid by the Customer.
JCR reserves the right to modify its prices at any time.
The total price of the paid order includes:
- The total price of the products purchased with any discounts deducted.
- The costs of preparing the order.
- The shipping costs of the order.
4.2 Price changes
In the context of commercial operations, flash sales or promotions, the prices displayed may change downwards temporarily over a period of time indicated on the site.
These possible price decreases cannot be the subject of a refund request from the buyer if he/she had paid for the product(s) at a higher price outside of the promotion period. Conversely, Ekoï is bound to respect the prices displayed on the day of the order validation, including in the event of an increase.
4.3 Price display error
The prices displayed are subject to visible errors. In the event of an obvious error in the display of prices, Ekoï undertakes to contact the customer to warn them and to offer them to pay the price difference or to cancel their order if they so wish.
In order to validate his order, the buyer must follow several steps:
- He/she selects the products he/she wishes to buy on the website www.ekoi.fr from the offer available on the website.
- He must identify himself (account already created) or create a customer account on the site by filling in the necessary information (last name, first name, physical address, phone number, email).
- The buyer validates the information related to his order (products, price, address).
- The buyer chooses the type of delivery and payment method he/she wants
- The buyer accepts the present GTC (check box)
- The buyer validates his order via a secure payment module (SSL)
This last step constitutes the irrevocable acceptance of the sales contract.
A summary of his order is sent to him via an email confirming his order.
We reserve the right to refuse any order from a customer with whom a dispute exists.
Unless there are exceptional circumstances, all products in an order will be delivered at one time. The products will be delivered to the delivery address that the customer will have indicated at the time of validation of his order.
For orders including one or more products unavailable at the time of shipment, Ekoï reserves the right to ship the order without the unavailable products. In this case, the buyer will be refunded or credited with a credit equivalent to the amounts of the unavailable products.
On receipt of the products, the customer must check the condition of the products they have purchased.
6.2 Delivery mode and rates
Many types of delivery are possible depending on the customer's choice.

Postage costs are inclusive of all taxes. The shipping cost amount is visible on the "SHOPPING SUMMARY" page in the purchase tunnel and corresponds to the "Shipping cost including VAT" line.
6.3 Delivery times
Delivery time varies depending on the type and country of delivery.
Delivery time is from the time the order is shipped from Ekoï's premises.
For any order placed between Monday and Friday before 2pm (excluding holidays), the order will be shipped the same day.
For orders placed between Monday and Thursday after 2pm (excluding holidays), orders will be shipped the next day after 2pm.
For orders placed on Friday after 2pm, Saturday and Sunday, orders will ship the following Monday afternoon (excluding holidays).
For orders placed on a holiday, orders will be shipped the following business day afternoon. Delivery times are once the order has shipped.
The delivery times announced on the site are valid from the moment the customer receives the order confirmation email.
For a delivery in a relay point, the customer has 15 days to come and get his parcel after notification by email of its availability. After this period, the package will be returned to Ekoï who will contact the customer again. In the absence of a response, the order will be cancelled and the customer reimbursed within the framework of the right of withdrawal.
Please note that the customer will not be reimbursed for the order
Products can only be returned under the right of withdrawal. The customer has 14 working days from the date of receipt of his order, to make his request for return by contacting the Customer Service. The customer then has 30 days to return the products.
For any return request, it is mandatory to contact Ekoï Customer Service before returning the products. If this was not done, the return request could not be processed upon receipt.

To make a return, it is necessary to validate the terms of return with the Customer Service.
An item returned within 30 days from the date of receipt of the order may be refunded or receive a credit note depending on the customer's choice.
An item returned beyond 30 days from the date of receipt of the order may only receive a credit note.
Return shipping is totally free for the customer (for Belgium, France Metropolitan, Germany, Spain, Italy, Luxembourg, Netherlands, Austria, Poland, Denmark, Czech Republic, Sweden, Slovenia,).
The procedure is as follows:
Make the request:
Just go to your customer account and then click on the My Product Returns section.
- Select the order concerned.
- Check the quantity of the product(s) you wish to return.
- Select one of the options: Have, Exchange or Refund.
- Once the return request is registered, your return label will appear on the screen and is ready to be printed.
Prepare the package:
- Add the photocopy of your invoice in the package or write your contact information as well as your order number on plain paper.
- Return the product(s) with the labels attached and in their original packaging.
- Print the return label and stick it on the package. If you reuse the original package, remember to remove the first label.
- If you wish to return a product by your own means, you can send it to the address:

Returned products can only be tried-on products (not worn in training, not washed). Gifts offered with products must also be returned (present on invoices, and order history).
Within the framework of the right of withdrawal, the customer has 14 working days from the date of receipt of his order, to make his request for return by contacting the Customer Service. He then has 30 days to return the products. The returned products must be in perfect condition, not worn and in their original packaging. In accordance with the provisions of Article L 121-20-2 of the Consumer Code, the right of withdrawal cannot be exercised for personalized and perishable products.
PLEASE NOTE, no right of withdrawal is possible on personalized and perishable products (e.g.: helmet with personalized sticker, personalized glasses...).

In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, JCR adheres to the Mediator Service.
After prior written application by consumers to JCR, the Mediator Service may be referred to for any consumer dispute for which settlement has not been reached.
To finalize his order, the customer has several means of payment. The products remain the property of Ekoï until the payment of the order. Ekoï reserves the right to block or cancel an order in case of total or partial non-payment of the order.
The customer has 1X or multiple times payment without charge by credit card.

10. ADVANCES AND REIMBURSEMENTS
For any defective products or for a product delivery error on our part, a credit note or a refund of the total amount received (product + shipping + return shipping, based on La Poste rates) will be offered to the customer.
11. PRODUCT WARRANTIES
EKOI warrants its products against manufacturing defects. Any EKOI product returned under warranty and found to be defective by EKOI, will be replaced within 8 days with an identical or superior model. At EKOI, we guarantee quality products. All products (helmets, textile, glasses, shoes, accessories) have a legal warranty period of 2 years (24 months).
Concerning specifically the sale of bicycles, themselves including spare parts (the "Complex Products"), Ekoï guarantees:
- The frame and fork for a period of 3 years
- that spare parts compatible with the Complex Products are available for a period of two (2) years from the product's online availability.
The warranty applies whenever a product is found to be defective due to a manufacturing defect.
Products returned for inspection must be sent postage paid to our warehouse (address below), accompanied by a dated proof of purchase and a letter explaining the reasons for the return.
The warranty does not cover normal wear and tear or damage caused by accident, neglect, abuse or damage resulting from exposure of the product to excessive temperature.
These GTCs are subject to the provisions of European Regulation 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, as well as those of Law No. 78-17 of 6 January 1978 on information technology, files and freedoms, and any other applicable regulations on the subject that may supplement or replace them at a later date.
The nominative information and personal data concerning the Customer are necessary for the management of his orders and for the commercial relations between JCR and the Customer. These data are for example: Name, Address, Telephone number, Email address, Credit card information, IP address. Without such information, JCR will not be able to provide its service. This information may be transmitted to companies that contribute to these relationships such as those responsible for the execution of services and orders for their management, execution, processing and payment.
This information and data is kept for security purposes in order to comply with legal and regulatory obligations. It may be used by JCR to send the Customer promotional offers, for statistical and anti-fraud purposes, for the legitimate interest of business development, technical improvement of its systems and knowledge of its Customers and, finally, where applicable with the Customer's consent, to personalize services, particularly through advertising. Depending on the choices made when creating or consulting his account, the Customer will therefore be likely to receive offers from JCR.
The Customer has the possibility to unsubscribe from JCR's newsletters at any time either by clicking on the link present in all emails or by contacting Customer Service.
The Customer can also consult and modify his personal data in his customer area.
The Customer has the right to access, modify, oppose, portability, limit and delete information concerning him/her, as well as to define directives concerning the fate of his/her personal data in the event of death, which he/she will address by simple mail to JCR, and by proving his/her identity:

14. APPLICABLE LAW
This contract is subject to French law, the language of the contract is the French language. Any dispute arising in connection with the application or interpretation of this contract shall be submitted to the French courts, which shall have sole jurisdiction.

INFORMATIONS REGARDING THE EXERCISE OF THE RIGHT OF WITHDRAWAL
Right of withdrawal
You have the right to withdraw from this contract without giving any reason within fourteen days. The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the last good. To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement (e.g. letter sent by post, fax or e-mail). You can also fill in and send us the sample withdrawal form. All the modalities of returns are detailed in paragraph 5.5 which we invite you to read to exercise the right of withdrawal.
